We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.
Delivery and Collection
Delivery (including delivery charges and timescales)
Free delivery on all orders
Please note, Regal and Barnes is a retailer for a number of manufacturers and uses a number of locations to dispatch the products to you. We only dispatch a limited number of items from our main office.
Please note that certain products and services may be subject to alternative delivery charges, restrictions and/or timescales. In particular:
Furniture can only be delivered within the UK mainland and a signature will be required on receipt. We are unable to deliver furniture to other parts of the UK, but please always check if you are interested and you live outside the mainland. If you are unable to accept the delivery offered, then it will be your responsibility to arrange a re-delivery with the couriers.
Please also note where we offer a 24hour turnaround for some products, some deliveries to the Isle of Man, Northern Ireland and some Scottish addresses will take 48 hours. For these regions, orders placed on Sunday for example will be delivered on Tuesday (48hours).
Delivery will be to the UK or international address. If no one is available at a residential or other address at the time of delivery, a note will be left to advise whether your order has been left in a safe place e.g. with a neighbour, or returned to depot.
All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order. Upon receipt of the order, you are advised to check the items for damage that may have occurred during transit. You then must report the damage to us within 24 hours in the form of an email, or similar, in order to replace the item.
We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control (the couriers).
In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Consumer Protection (Distance Selling) Regulations 2000 and other applicable legislation. Similar rights may apply for some international deliveries. For further information about your legal rights see “Your Right to Cancel” section below and contact your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau for UK customers).
Collection from the Office
We usually don’t offer the collection from the office facility unless this is specifically agreed in writing with the customer.
Where the supply of your product(s) or service(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.
Changes to your order
Any changes to your order must be notified to us in writing and within a reasonable time. If you amend or change your order you may find there are changes to your delivery timetable and / or the price you pay for the item (you will be charged the current selling price on the day you amend your order).
Your right to cancel
If you are contracting with us as a consumer online or by phone, a customer has the right to cancel an order (under the Consumer Rights Directive 2011/83 as implemented in the applicable EU member state (“CRD”)), all or part of your contract at any time up to 14 calendar days after the day on which you receive the goods or services you ordered. We define receiving the goods as the day the goods are received and physically collected (if agreed prior) from our office. Regal and Barnes also complies with the current Consumer Rights Act 2015.
The good news is, Regal and Barnes operates a 30 day ‘goodwill’ returns policy, so if you come back to us anytime in this period unhappy with your purchase, then we may be able to process a full refund less the cost from yourself to physically return the goods back to an agreed address. The returned goods must not be damaged in anyway whatsoever and contain all the original packaging – therefore they have to be in a re-saleable condition.
Any paid delivery charge will NOT be included in your refund once we have received all (not part) of your order to a specified address. Regal and Barnes will process your refund with 14 days of receipt of the products, to the specified address. You must take reasonable care of the goods while in your possession and they must be returned to us before we can issue your refund.
Specified Returns Address
Please check with customer services (email: firstname.lastname@example.org) to confirm the return address. This will vary product to product.
For further information about your statutory rights, contact your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau if you are in the UK). If you are a non-EU customer, please speak to our customer service by emailing email@example.com
If you wish to cancel (or are considering cancelling) a product or service you have ordered from us, please be aware of the following terms that apply:
Applicability of cancellation rights: Legal rights of cancellation under the CRD available for UK or EU consumers do not apply to certain products and services (for example, made to measure orders and personalised items), any products with a seal where the seal is broken.
Damaged or incorrectly supplied products: You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (by post, phone or email only) within 24 hours. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied. Speak to customer service on firstname.lastname@example.org to confirm a delivery address to send the products back.
Damage during the course of returning products: If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery or a courier service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.
Other cancelled products: If you want to cancel products that are not damaged or incorrectly supplied, then you must inform us of this within 30 calendar days the day after you receive the goods / services OR when they are collected, in accordance with the CRD or otherwise as soon as possible. We cannot take product returns after this period.
You must take reasonable care of the products that you wish to cancel. Products should be returned in or with their original packaging or in the case of furniture, collection arrangements made, promptly at your cost which will be notified to you at the time of cancellation.
This is not intended to be a full statement of all your rights under the CRD. Full details of your rights under the CRD are available in the UK from your local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office.
In the case of damaged or incorrectly supplied goods, we may offer you a replacement product. Any refunds given by us will be made to the debit/credit card account or PayPal provided when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return or for which we arrange collection, as outlined above.
Where we deliver products to a third party in accordance with your order, you will only be able to exercise this cancellation right if you can return the goods to us (or arrange for us to collect them).
Our Goodwill Refund Policy
Our “goodwill” refund policy does not affect your legal rights under the CRD or other legislation.
Our “goodwill” refund or exchange policy (where there is no legal right to a refund or exchange under the CRD or otherwise) is offered on goods that are returned in a resalable condition with a receipt or parcel summary document within 30 days of purchase. Please note, after 30 days we are under no corporate obligation to refund unwanted goods, unless there is documentary evidence stating otherwise from an authorised member of staff in Regal and Barnes team.
Some of these items may have their own terms and conditions which will be provided to you at the time of purchase.
If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.
Reporting Faulty items
You have the right to report an item as faulty within the first 6 years of purchase, but your rights and obligations as a consumer according to the Consumer Rights Act will vary. In the first 6 months of purchase, it is on the onus on the retailer to prove the products were not-faulty on receipt or delivery. You may want to ask for a repair or replacement of the products. If a repair or replacement is not possible then you are entitled to a full refund.
If the retailer has been notified of a fault after the first 6 months of purchase, then the onus is on the consumer to prove that the products were faulty at the time of delivery. We reserve the right to ask the consumer for some form of expert report, opinion or evidence of similar problems across the product range sold or why the product certification of the manufactured products is incorrect.
The Buyer’s remedies in respect of any claim under the foregoing express warranty or any condition or warranty implied by law to any other claim in respect of the Goods or any workmanship in relation to them (whether or not involving negligence on the part of the Company) shall, in all cases, be limited to the repair or replacement of the Goods or as aforesaid. The Company shall have no liability for any costs of installation, removal or inspection costs incurred by the Buyer or any third party in respect of any warranty claim. This, however, does not limit the Buyer from making a claim for loss, damage or personal injury as a result of faulty goods supplied by the Manufacturer/Producer, as per consumer rights in the Consumer Protection Act of 1987.
